Participant Waiver & Assumption of Risk

Voluntary participation

Presence in Motion is a community wellness and recreational experience. It is not medical treatment, physiotherapy, psychotherapy, counselling or individualized medical or fitness advice. Participation is voluntary.

Nature of the activity

Activities may include outdoor walking, warm-up and cool-down movement, standing, group activities and reflection. The planned route may include uneven and jagged natural terrain, slopes, roots, rocks, loose surfaces, mud, water, wet or slippery areas, vegetation, and other natural or changing outdoor conditions.

The planned October 18, 2026 route at Erindale Park is not wheelchair-accessible.

Assumption of risk

Risks may include slips, trips, falls; uneven, unstable or slippery terrain; roots, rocks and holes; strains and sprains; fatigue or overexertion; changing weather, rain, wind and sun; insects and plants; contact or collision with participants, members of the public, animals or objects; roads, pathways, parking areas and other park users; and other foreseeable or unforeseeable risks.

By participating, you freely choose to take part and knowingly accept these risks.

Personal responsibility

You are responsible for deciding whether you are capable of participating safely, choosing an appropriate pace, wearing suitable footwear and clothing, bringing hydration, paying attention to your surroundings, and stopping if you feel unsafe. If you have concerns about participation, seek advice from a qualified health professional.

You will not rely on Presence in Motion, 6Fifteen, QuantumWell, hosts, volunteers or partners to assess your personal medical fitness.

Release and waiver

To the fullest extent permitted by law, you voluntarily assume the risks of participation and release and waive claims against Presence in Motion, 6Fifteen, QuantumWell, and their organizers, hosts, representatives, volunteers and agents arising from or relating to your participation, including injury, loss or damage resulting from ordinary risks, except where a claim cannot lawfully be released or waived.

Nothing in this waiver excludes or limits liability that cannot legally be excluded or limited.

Personal property

You are responsible for your own belongings. The organizers are not responsible for loss, theft or damage except where responsibility cannot legally be excluded.

Emergencies

Organizers or volunteers may contact emergency services where reasonably appropriate. Presence in Motion does not provide medical care and does not guarantee that medical personnel will be present.

Media consent is separate

This waiver does not constitute consent for promotional use of your photograph, video, voice or likeness. Your media preference is collected separately during registration, and selecting No does not prevent registration.

Acknowledgement

You confirm that you have had the opportunity to read this document, understand its general nature and effect, understand that participation involves risks, and are participating voluntarily. By checking the required acknowledgement during registration, you agree to this Participant Waiver & Assumption of Risk.
